1. Who we are

This website ("Motionry") sells digital products for post-production work. For any question about these terms, contact [email protected].

These Terms of Service ("Terms") form a binding agreement between Motionry ("we", "us") and you ("Customer", "you") governing your access to this website and the purchase and use of our digital products.

2. Products

Motionry sells digital goods for post-production work: plugins, presets, LUTs and sound packs (collectively, the "Products"). All Products are delivered electronically as file downloads. No physical goods are shipped.

Every purchase is a one-time purchase, not a subscription. There is no recurring billing. Free updates for a Product are provided for the period stated on that Product's page.

3. Orders, price and payment

Prices on the website are displayed in US Dollars and shown as the final amount — no extra fees or taxes are added at checkout. Payment is processed by our payment provider; we do not store card data on our servers.

A contract of sale is formed only after (i) you place the order, (ii) you tick the mandatory consent checkbox on the checkout page, and (iii) we send you an order confirmation by email containing the download link.

4. Immediate access & waiver of withdrawal right

Under Article 16(m) of Directive 2011/83/EU on Consumer Rights, the statutory 14-day right of withdrawal does not apply to the supply of digital content not delivered on a tangible medium once performance has begun with the consumer's prior express consent and acknowledgement that the right of withdrawal is thereby lost.

By ticking the mandatory checkbox at checkout ("I agree to the terms of supply of digital products and I request immediate access, understanding that this waives my 14-day right of withdrawal once the download has been activated"), you give that express consent. 5. License grant

Subject to full payment, Motionry grants you a non-exclusive, non-transferable, worldwide license to use the Products in commercial and non-commercial projects, subject to the seat count listed on the invoice (one seat per purchase, unless otherwise stated). You may not resell, sub-license, redistribute, share on file-hosting services, or include the Products in stock libraries, template marketplaces or NFT/AI training datasets. 6. Delivery

Products are delivered by download link sent to the email address you provide at checkout. Links remain valid for 12 months and can be re-issued on request. Delivery is deemed to occur when the email leaves our system.

7. Refunds

Our full refund rules are set out in the Refund Policy, which forms part of these Terms.

8. Warranty & liability

We provide the Products with reasonable skill and care. Compatibility with the host applications listed on the Product page is warranted for the current major version at time of purchase. To the maximum extent permitted by law, our aggregate liability arising out of or in connection with these Terms is limited to the amount paid by you for the affected Product. Nothing in these Terms excludes liability that cannot be excluded under Portuguese or EU consumer law.

9. Personal data

We process personal data in accordance with the EU General Data Protection Regulation (GDPR). See our Privacy Policy for details of what we collect, why, how long, and your rights of access, rectification, erasure, portability and objection.

10. Dispute resolution

These Terms are governed by Portuguese law. EU consumers may submit disputes to the European Commission's online dispute resolution platform atec.europa.eu/consumers/odr. The courts of Lisbon have jurisdiction, without prejudice to mandatory consumer protections in your country of residence.

11. Changes to these Terms

We may update these Terms from time to time. The version applicable to your order is the version published on this page at the moment you complete checkout. Material changes will be announced on the website at least 14 days before they take effect.
